WHAT HAPPENS IN A CLASS ACTION CASE?
Some class action settlements offer Class Members compensation as well as injunctive relief. Injunctive relief is a type of legal remedy that requires a defendant named in a civil lawsuit to stop a certain action or behavior. This action is taken to help people who have been injured by past bad acts while changing future action.
WHY MASS CLASS ACTION?

Companies and Gov’t Agencies have deep pockets, which can be used to drag out the process.  Suits filed by Individuals are often dismissed.  Appeals, if successful, are costly and may lead to a trial in about 9 years. 

F:  Fighting the wrongs committed against you is most effective when multiple people make similar claims against a company or entity; especially in the face of juries comprised of majority race members.

IF I SUBMIT A FORM WILL I BE CONTACTED?

Not everyone who submits their information will be contacted. Class Actions may receive hundreds or thousands of responses making it impossible for us to contact everyone. We review submissions and will contact people based on the overall data relative to the cases.  The strongest claims are selected to serve as the named plaintiffs in a lawsuit. WHY DO I HAVE TO PROVIDE MY DATE OF BIRTH AND A PHONE #?

We need the them to access information like police reports and court documents, to contact you, to further identify you, and to validate your account.  DO NOT SUBMIT A FALSE COMPLAINT. If you have not been a victim of the company or entity, do not submit a form. Doing so could negatively affect the affected parties and lead to legal action.

WHAT IS A MASS TORT?

Civil litigation involving a group of victims suing the same company or entity over injuries. WHAT DOES IT COST?

It will not cost you any money to participate in a class action lawsuit investigation or lawsuit. It is, however, important for participants to promptly reply to any communications from the attorneys.  Failure to respond may result in the loss of representation.

WHY ARE COMMUNITIES AND AGENTS A CATEGORY?

Some communities have a long history of being hostile spaces. Courts and Companies are manned by a community of people, also known as Employees or Agents. Courts, Corporate Headquarters, and other Government entities are most often located in geographical areas with a history of hostility – this population represents the jury pool.

 When a company or entity is sued, “Scope of Employment” and “Policies and Procedures” or “Sovereign   Immunity” are often invoked. Using PCC and Judge Ash as an example, Judge Ash was an Employee or Agent functioning in a Gov’t Agency (Court), in a historically hostile space, Murfreesboro, Rutherford County TN.  Some believe suing Agents as part of a Class Action is the way to cover all your bases, as Agents sometime have considerable assets.

WHAT IF THE STATUTE OF LIMITATIONS HAS PASSED ON MY CLAIM?

Statues of Limitations vary, dependent, on a variety of factors, to include the industry or area of business in which the entity operates.  Applicable statues of limitations are researched to determine this information. Even if the statute of limitations has run on your individual claim, you should still enter the details of your experience into the database as it may help establish a pattern of behavior on the part of the company or entity. Together we can hold companies accountable for their wrongdoing!!

WHAT IS MULTIDISTRICT LITIGATION (MDL)?

When multiple lawsuits with similar claims from different states and/or federal courts are transferred to a single federal court before a single judge. While a class action lawsuit utilizes one plaintiff or a small group of plaintiffs to bring claims on behalf of an entire Class, MDL (s) are individual groups of lawsuits that are heard in a single court. In an MDL each individual lawsuit is a single plaintiff seeking damages for his or her specific injuries.

CAN I BE BOUND BY A SETTLEMENT THAT I DIDN'T KNOW ABOUT?

If a class action lawsuit results in declaratory or injunctive relief (a court order for the defendant to stop a specified act or behavior) instead of monetary damages, the parties may not be required to provide notice of the litigation to Class Members, and they may not be able to opt out of the litigation. Even if you did not know about the existence of a class action lawsuit, you may be prohibited from taking legal action against the defendant over the same legal issues that were resolved in the case.
